Terms of Service

The agreement between you and SensaCat. Short, because a monitoring tool does not need twenty pages of it.

1. The agreement

These terms apply when you create a SensaCat account or use the service at sensacat.com, including the free plan and the free tools. If you are agreeing on behalf of a company, you confirm you are allowed to bind it, and "you" means that company.

2. What we provide

SensaCat monitors heartbeats, business flows, credentials and domains, and sends alerts to the channels you configure. What your plan includes — how many monitors, flows, credentials and domains, which alert channels, how long alerts are kept, how often domains are checked — is set out on the pricing page, which is generated from the live plan limits.

We may add, change or remove features. If a change removes something material from a paid plan you are on, we will tell you before it happens and you may cancel for a pro-rata refund of the unused period.

3. What monitoring is not

This one matters more than the rest, so it is not buried in the disclaimer section.

SensaCat is a monitoring tool, not a guarantee that you will be told about every problem. An alert depends on things outside our control: your application sending events, your network reaching us, your email provider or Slack or your phone carrier delivering the message, and the alert channel you configured still being valid. A failure at any of those points means an alert that does not arrive.

You remain responsible for your own systems and for the consequences of their failure. Do not use SensaCat as the only safeguard for anything where a missed alert causes injury, or where a regulator requires a specific level of assurance.

4. Your account

  • You must give accurate registration details and keep your email address current — it is how we reach you about the account.
  • You are responsible for everything done under your account, and for keeping your password, API key and ingest tokens confidential. Anyone holding your account API key and a resource's ingest token can write events to that resource.
  • If a key or token leaks, rotate it from the dashboard. Rotation takes effect immediately and there is no overlap window, so update every sender at the same time.
  • Tell us promptly at the address below if you believe your account has been accessed by someone else.
  • One human per user account. Team members get their own accounts within your organisation rather than sharing one login.

5. Acceptable use

Do not use SensaCat to:

  • break the law, infringe someone's rights, or send anything unlawful, deceptive or abusive through our alert channels;
  • probe, scan or load-test hosts you do not control, including through the free tools — the tools refuse internal and private addresses, and attempting to get round that is a breach of these terms;
  • send us payload contents, special category personal data, payment card numbers or credentials as event data. Events are metadata only;
  • resell the service, or use it to build a competing monitoring product;
  • work around plan limits, rate limits or the free-tool quotas, whether by scripting, multiple accounts or otherwise;
  • interfere with the service's operation or attempt to access another customer's data.

We may suspend an account that is doing any of these, and will tell you why. Where the breach is minor and fixable, we will ask you to fix it first.

6. Your data

Your monitoring data stays yours. We process it to run the service for you and for nothing else — we do not sell it, mine it, or use it to train models. The privacy policy sets out what we collect and who else touches it, and forms part of these terms.

You can export or delete your data at any time. When you close your account we delete it within 30 days, except for invoices we are required to keep. Retention while the account is open follows your plan.

You grant us the limited licence needed to store, transmit and display your data in order to provide the service. That licence ends when the data is deleted.

7. Plans, billing and cancellation

  • The free plan is free, with no card and no time limit. It has lower limits, not fewer guarantees.
  • Paid plans are billed monthly in advance in US dollars through our payment provider. Prices exclude any tax that applies where you are.
  • Upgrades and downgrades take effect immediately and are prorated for the rest of the billing period.
  • You can cancel at any time from billing settings. Cancellation takes effect at the end of the period you have paid for; we do not refund the remainder of a period you chose to leave early, except where these terms or the law say otherwise.
  • If a payment fails we will retry and email you. An account that stays unpaid moves to the free plan, which keeps your data and your history but stops anything above the free limits.
  • If we raise prices, existing subscriptions keep their price for at least 30 days after we tell you, and you may cancel before the new price applies.

8. Availability

We aim to keep SensaCat running continuously and to give notice of planned maintenance. We do not currently offer a contractual uptime commitment or service credits on the self-serve plans; if you need one, talk to us about Enterprise before you buy, rather than after.

The service is provided "as is" and "as available". To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Liability

Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, revenue, goodwill or anticipated savings, or for loss arising from an alert that was not delivered or was delivered late. Our total liability for all claims in any twelve-month period is limited to the amount you paid us in that period, and on the free plan, to US$100.

You are responsible for your use of the service, including anything you send through it and any claim arising from that.

10. Ending the agreement

You may stop using SensaCat and close your account at any time. We may end the agreement on 30 days' notice, or immediately if you materially breach these terms, if required by law, or if your account is being used to harm others. If we end it for convenience, we refund the unused part of any period you have paid for.

On termination your right to use the service stops, and the sections on your data, liability and governing law survive.

11. Changes to these terms

We may update these terms. The date at the top changes when we do. For a material change we will email account holders at least 30 days beforehand; continuing to use the service after it takes effect means you accept it, and if you would rather not, you may cancel and be refunded for the unused period.

12. General

These terms, together with the privacy policy, are the whole agreement between us on this subject. If a provision is unenforceable, the rest still applies. Not enforcing something once does not waive it. You may not assign this agreement without our consent; we may assign it as part of a merger or sale of the business.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that either party may seek an injunction wherever it is needed.
